According to the "Legal Daily" report, the "Food Safety Law" passed by the Standing Committee of the National People's Congress on February 28 established eight important legal systems in an effort to fundamentally build China's food safety.
Clear food safety supervision system
Since 2004, China has implemented a segmented supervision system for food safety. Agriculture, quality inspection, industry and commerce, health, food and drug supervision departments ...... From the field to the table, every link of food production and circulation has a "heavy guard". However, in practice, new problems have gradually emerged. For food safety risk assessment, standard formulation, information disclosure and other matters that do not belong to any link, it is not clear which department is responsible, which objectively leads to the phenomenon of overlapping functions and unclear responsibilities of departments.
Especially after the "Sanlu Milk Powder Incident" occurred, the society demanded to change the shortcomings of the existing regulatory system, and the call for effective supervision was getting louder and louder. To this end, the Food Safety Law further clarifies the food safety supervision system from three aspects.
The first is to further clarify the specific responsibilities of the various departments that implement segmented supervision. The health department shall assume the responsibility of comprehensive coordination of food safety, be responsible for food safety risk assessment, formulation of food safety standards, publication of food safety information, formulation of qualification accreditation conditions and inspection specifications of food inspection institutions, and organize investigation and handling of major food safety accidents. The quality inspection, industry and commerce, and food and drug supervision departments shall respectively supervise and manage food production, food circulation, and catering service activities. The agricultural department mainly conducts supervision in accordance with the provisions of the Agricultural Product Quality and Safety Law, but the formulation of quality and safety standards for edible agricultural products and the publication of information on the safety of edible agricultural products are in accordance with the relevant provisions of the Food Safety Law.
Second, on the basis of segmented supervision, the State Council established the Food Safety Committee as a high-level deliberative and coordinating body to coordinate and guide food safety supervision.
The third is to further strengthen the regulatory responsibilities of local governments and their relevant departments. Local governments at or above the county level are uniformly responsible for, leading, organizing, and coordinating the food safety supervision work in their respective administrative regions, establishing and improving the working mechanism for the whole process of food safety supervision; uniformly leading and directing the response to food safety emergencies; improving and implementing the food safety supervision responsibility system, and evaluating and assessing the food safety supervision departments. In addition, in order to ensure the corresponding responsibilities and the smooth flow of government orders, local governments must also determine the regulatory responsibilities of the health, agriculture, quality inspection, industry and commerce, and food and drug regulatory departments at the same level in accordance with the law.
Establish safety risk assessment system
"Sudan red duck eggs" make society "smell egg color", "poisonous coffee" makes people avoid coffee ...... In recent years, a series of food safety incidents, because of the lack of timely and authoritative voice, various statements contradict each other, so that the people are at a loss.
"Foods that do not meet food safety standards are substandard foods, but they are by no means equivalent to toxic foods. Calling substandard foods as toxic foods in general exaggerates the degree of food safety risks." Some experts pointed out.
Food safety risk assessment is a scientific assessment of the possible adverse effects of biological, chemical and physical hazards in food on human health. It has become a common practice in many countries to take the results of food safety risk assessment as the scientific basis for the formulation of food safety standards and policies. The information obtained from food safety risk monitoring is one of the important bases for food safety risk assessment.
